Presented below is the First Reading Draft of the Unified Development Code, to be formally introduced before City Council on August 11, 2009. This draft incorporates Planning Commission revisions and recommendations through June 22, 2009. It also includes minor changes since that time for clarification and correction of  typographical and similar errors, but is substantially similar to the draft reviewed by City Council during June 30th and July 21st work sessions. All prior drafts are still available here.

In total, the City Council First Reading Draft is based on 19 public meetings, Zoning Advisory Committee concerns and public comments. Numerous public concerns were addressed at the Planning Commission meetings in June which resulted in changes to the draft code as recommended to the City Council.

General Provisions

This chapter carries forward general provisions in the current zoning and subdivision regulations; including language on general applicability, general rules of interpretation, and severability.

Chapter 15.04
Review Authorities

This chapter consolidates all review and approval procedures into one chapter of the revised code, including both subdivision and zoning procedures.

Chapter 15.06
Review Procedures

This chapter is an addition to the code in which we have consolidated all provisions regarding operation of review and decision-making bodies and provided a description of each body’s roles and responsibilities in administering and enforcing the code.

Chapter 15.08
Zone Districts

The primary functions of this new Chapter is to establish the zone districts and overlay districts and add purpose statements, delineate district-specific regulations, development standards, and use standards for each zone district.

Chapter 15.10
Use Regulations

This chapter defines specific use regulations for the zoning districts. This chapter specifically eliminates the dependency on pyramidal zoning and clearly states all uses and what districts they are permissible in.

Chapter 15.12
Dimensional Standards

This chapter consolidates bulk and dimensional standards - such as height, density, and lot area. The material is presented in tables by zone district for easy reference.

Chapter 15.14
Development Standards

This chapter is a compilation of regulations related to the location, design, and relationships between sites and structures.  In Laramie, many of these regulations were previously located throughout the code, so this Chapter will provide a single location for identifying applicable standards.  A variety of new standards are introduced within such as revised parking and landscaping standards, commercial and residential design standards and specific development requirements in sensitive areas.

Chapter 15.16
Subdivision

This chapter establishes the basis for subdivision procedures.  The subdivision procedures are tied into the development standards outlined in the new Development Standards Chapter.

Chapter 15.18
Improvements

This Chapter is a new staff initiated Chapter indented to strengthen the connection between required public improvements for new development and subdivisions.  Additionally the intent of the Improvements Chapter is to incorporate requirements for bonding and security for public improvements in order to eliminate our present subdivision agreement.   This Chapter will still go through additional review by the City.

Chapter 15.20
Floodplain Management

This chapter consolidates and floodplain regulations.  The Floodplain Management Chapter applies to all developments and subdivisions within the City and reflects current floodplain management practices.

Chapter 15.22
Non-Conformities

This chapter consolidates language on non-conformities.  Some additional typical provisions commonly found in similar codes have been added to regulate nonconforming lots and lots not in conformance with development standards.  Also added are new provisions addressing nonconforming signs per page 48 of the Diagnosis.

Buildings and
Construction

This chapter reformats the existing Title 15.  The most notable change is that all fees have been pulled out of Code and will be included in a new fee schedule to be adopted by City Resolution prior to final UDC adoption.

Chapter 15.26
Enforcement

This chapter establishes procedures through which the City seeks to ensure compliance with the provisions of this Title and obtain corrections for violations of this Title.  The chapter also sets forth the remedies and penalties that apply to violations of this Title.

Definitions

This Chapter consolidates commonly use definitions in the new UDC in a simple format which will be located at the end of the Title.
